1. Definitions

  • Service Provider: ScentBreak, established in the Netherlands.

  • Platform: the website and any related applications of the Service Provider.

  • User: any individual or legal entity using the Platform.

  • Business Customer: a User acting in the course of business.

  • Consumer: a natural person not acting in the course of business.

  • Services: all services offered, including:

    • requesting perfume vending machines;

    • marketing and advertising via vending machines;

    • displaying vending machine locations.

2. Applicability

2.1 These Terms apply to all use of the Platform and Services.
2.2 Deviations require written agreement.
2.3 User’s own terms are expressly rejected.

3. The Platform and Services

3.1 The Platform enables Users to:

  • submit requests for vending machines;

  • advertise via vending machines;

  • view machine locations.

3.2 Submitting a request does not guarantee acceptance.
3.3 The Service Provider may refuse requests at its discretion.

4. Agreements and Performance

4.1 Agreements are concluded only after explicit confirmation.
4.2 No guarantees are given regarding commercial results or marketing impact.
4.3 Timeframes are indicative unless expressly agreed otherwise.

5. Marketing and Advertising

5.1 Business Customers are responsible for supplied content.
5.2 Content must not violate laws or third-party rights.
5.3 The Service Provider may refuse or remove content without liability.

6. User Obligations

6.1 Users must provide accurate information.
6.2 Misuse of the Platform is prohibited.
6.3 Violations may result in suspension or termination.

7. Liability

7.1 The Service Provider is not liable for indirect or consequential damages.
7.2 Liability is limited to the insured amount or the invoiced service amount.
7.3 This limitation does not apply in cases of intent or gross negligence.

8. Availability

8.1 Continuous availability is not guaranteed.
8.2 Maintenance may cause temporary downtime.

9. Intellectual Property

9.1 All intellectual property rights belong to the Service Provider.
9.2 Unauthorized use is prohibited.

10. Privacy

10.1 Personal data is processed in accordance with applicable laws.

11. Termination

11.1 Access or agreements may be terminated in case of violations or legal requirements.

12. Governing Law

12.1 Dutch law applies.
12.2 Disputes shall be submitted to the competent court in the Netherlands.
